De aanbevelingen in de app zijn persoonlijk en bedoeld als richtlijn. Openingstijden, prijzen en diensten van restaurants, musea en andere plekken hangen af van derden en kunnen veranderen; controleer ze voordat je gaat. Tips van reizigers worden geschreven door andere gebruikers en vallen onder hun eigen verantwoordelijkheid.

Verkoopvoorwaarden

1. Wat je koopt

Een toegangspas voor ‘Albano’s Valencia’, een webapp met een kaart van plekken die Albano aanbeveelt, met beschrijvingen en tips van andere reizigers. De prijs en de duur van de pas zie je voordat je betaalt (op dit moment € 4,99 voor 7 dagen toegang). De prijs is een eindprijs, inclusief belastingen. Het is een eenmalige betaling: er is geen abonnement en geen automatische verlenging.

2. Aankoop en betaling

De betaling verloopt via Stripe. Om een pas te kopen moet je meerderjarig zijn. De overeenkomst komt tot stand zodra de betaling is bevestigd. Op dat moment zie je je toegangscode (bijvoorbeeld ALB-XXXXXXXX) op het scherm en sturen we hem je per e-mail, samen met de bevestiging van je aankoop. De overeenkomst is beschikbaar in het Nederlands, Engels en Spaans.

3. Duur en gebruik van de pas

De pas gaat in op het moment van aankoop en geldt voor het aangegeven aantal dagen (7 dagen is 7 × 24 uur). Codes die je bij een fietstour krijgt, gaan in bij het eerste gebruik. Je mag je code op je eigen apparaten gebruiken. De pas is persoonlijk: doorverkopen of openbaar delen is niet toegestaan. We kunnen codes blokkeren die misbruikt worden.

4. Herroepingsrecht

Als consument heb je bij een online aankoop normaal 14 dagen bedenktijd. Hier gaat het om digitale inhoud die je direct ontvangt. Daarom vragen we je vóór de betaling uitdrukkelijk in te stemmen met directe toegang en te erkennen dat je je herroepingsrecht verliest zodra de toegang is gestart (artikel 103, onder m, van het Spaanse Koninklijk Wetgevend Besluit 1/2007, de algemene consumentenwet, ter uitvoering van EU-richtlijn 2011/83/EU). We bevestigen deze instemming in de aankoopmail.

5. Als iets niet werkt

Werkt de app niet door een probleem aan onze kant? Mail ons dan op info@albanobiketours.com met je code. Kunnen we het niet binnen een redelijke termijn oplossen, dan betalen we je het bedrag terug. Dit beperkt je wettelijke rechten als consument op conforme digitale inhoud niet.

6. Inhoud

De plekken en teksten zijn persoonlijke aanbevelingen. We kunnen op elk moment plekken bijwerken, toevoegen of verwijderen om de gids actueel te houden. We zijn niet verantwoordelijk voor diensten van derden (restaurants, musea enz.) of voor wijzigingen in hun openingstijden, prijzen of beschikbaarheid.

7. Tips van reizigers

Als je een tip plaatst, zien andere pashouders die, samen met de naam en het land die je invult (allebei optioneel). Plaats geen illegale, beledigende of reclame-inhoud, en geen persoonsgegevens van anderen. We kunnen elke tip verbergen of verwijderen. Door een tip te plaatsen geef je ons toestemming hem in de app te tonen.

8. Beschikbaarheid

We doen ons best om de app altijd te laten werken, maar er kunnen korte onderbrekingen zijn door onderhoud of door oorzaken buiten onze macht.

9. Toepasselijk recht

Op deze voorwaarden is het Spaanse recht van toepassing. Als consument behoud je de bescherming die de wetten van je woonland je geven en kun je naar de rechter in je woonplaats stappen. Heb je een klacht? Neem dan eerst contact met ons op: we proberen het samen met je op te lossen. Op elke aankoop zijn de voorwaarden van toepassing die gelden op het moment van betalen.

Welke gegevens we verwerken en waarom

• Aankoop van de pas: je e-mailadres (dat Stripe ons na de betaling doorgeeft), je toegangscode, de data van je pas en de betalingsreferentie. We gebruiken ze om je toegang te geven, je code te sturen en terug te vinden, vragen te beantwoorden en aan boekhoudkundige verplichtingen te voldoen. Grondslag: uitvoering van de overeenkomst en wettelijke verplichtingen. Je kaartgegevens worden door Stripe verwerkt; wij zien ze nooit.
• Tips van reizigers: de tekst, de naam en het land (optioneel), de plek en de datum, intern gekoppeld aan je pas. Ze worden getoond aan andere pashouders (nooit je code of e-mailadres). We krijgen een melding per e-mail zodat we ze kunnen modereren. Grondslag: je toestemming bij het plaatsen; je kunt ons vragen ze te verwijderen.
• Beveiliging: we bewaren je IP-adres met tijdstip maximaal 24 uur om misbruik te voorkomen, zoals het uitproberen van veel codes achter elkaar. Daarnaast kan de server technische gegevens (IP-adres, datum, pagina) een beperkte tijd in zijn toegangslogs bewaren. Grondslag: ons gerechtvaardigd belang om de dienst te beschermen.
• Locatie: als je dat toestaat, gebruikt je telefoon je locatie om plekken in de buurt en afstanden te tonen. Je locatie wordt niet naar onze server gestuurd. Je kunt de toestemming altijd weigeren of intrekken.

Gegevens op je telefoon

De app bewaart in je browser de gekozen taal, je toegangscode, een kopie van de plekken voor offline gebruik en of je de installatiemelding hebt gesloten. Dat is alleen nodig om de app te laten werken. We gebruiken geen cookies en geen analyse-, tracking- of advertentietools.

Met wie we gegevens delen

• IONOS (webhosting en verzending van e-mails, servers in de EU), als verwerker.
• Stripe (Stripe Payments Europe Ltd., Ierland) voor de betaling. Stripe verwerkt gegevens ook als eigen verantwoordelijke volgens zijn eigen privacybeleid en kan ze buiten de EU doorgeven met de waarborgen die de AVG vereist.
• OpenFreeMap en OpenStreetMap: je browser laadt de kaart rechtstreeks van hun servers, die daarbij je IP-adres ontvangen.
• WhatsApp en Google Maps: alleen als je op hun knoppen tikt, opent die dienst en gelden hun eigen voorwaarden.

We verkopen je gegevens niet en gebruiken ze niet voor reclame.

Hoe lang we ze bewaren

Gegevens van de pas: zolang de pas actief is en daarna gedurende de wettelijke termijnen (bijvoorbeeld voor boekhouding en belastingen). Tips: zolang de app actief is of tot je vraagt ze te verwijderen. IP-adressen voor beveiliging: maximaal 24 uur.

Je rechten

Je kunt vragen om inzage in je gegevens, correctie, verwijdering, bezwaar of beperking van de verwerking, overdracht in een draagbaar formaat, of je toestemming intrekken. Mail ons op info@albanobiketours.com met je code of e-mailadres. Ben je niet tevreden met ons antwoord, dan kun je een klacht indienen bij de Spaanse toezichthouder (www.aepd.es) of bij de toezichthouder in je eigen land, zoals de Autoriteit Persoonsgegevens.

Terms of sale

1. What you buy

An access pass to “Albano’s Valencia”, a web app with a map of places recommended by Albano, their descriptions and tips from other travellers. The price and duration of the pass are shown before you pay (currently €4.99 for 7 days of access). The price is final, taxes included. It is a one-time payment: there is no subscription and no automatic renewal.

2. Purchase and payment

Payment is processed by Stripe. You must be an adult to buy a pass. The contract is concluded when the payment is confirmed. At that moment you see your access code (for example ALB-XXXXXXXX) on screen, and we email it to you together with the confirmation of your purchase. The contract is available in Dutch, English and Spanish.

3. Duration and use of the pass

The pass starts at the moment of purchase and lasts the number of days shown (7 days means 7 × 24 hours). Codes given with a bike tour start the first time they are used. You may use your code on your own devices. The pass is personal: it may not be resold or published. We may block codes that are used abusively.

4. Right of withdrawal

As a consumer you normally have 14 days to withdraw from an online purchase. In this case you receive digital content immediately. That is why, before paying, we ask you to expressly agree that the pass starts right away and to acknowledge that you lose your right of withdrawal once access has started (Article 103(m) of Spanish Royal Legislative Decree 1/2007, the General Law for the Protection of Consumers and Users, implementing EU Directive 2011/83/EU). We confirm this agreement in the purchase email.

5. If something doesn’t work

If the app doesn’t work because of a problem on our side, email us at info@albanobiketours.com with your code. If we can’t fix it within a reasonable time, we will refund you. This does not limit your statutory consumer rights regarding the conformity of digital content.

6. Content

The places and texts are personal recommendations. We may update, add or remove places at any time to keep the guide up to date. We are not responsible for third-party services (restaurants, museums, etc.) or for changes to their opening hours, prices or availability.

7. Traveller tips

If you post a tip, other pass holders will see it, together with the name and country you enter (both optional). Do not post illegal, offensive or promotional content, or personal data of other people. We may hide or delete any tip. By posting it, you allow us to show it in the app.

8. Availability

We do our best to keep the app running at all times, but there may be short interruptions for maintenance or for reasons beyond our control.

9. Applicable law

These terms are governed by Spanish law. If you are a consumer, you keep the protection given to you by the laws of your country of residence and you may go to the courts of your place of residence. If you have a complaint, please contact us first: we will try to solve it with you. Each purchase is subject to the terms in force at the time of payment.

What data we process and why

• Buying a pass: your email address (provided to us by Stripe after payment), your access code, the dates of your pass and the payment reference. We use them to give you access, send and recover your code, handle support requests and meet accounting obligations. Legal basis: performance of the contract and compliance with legal obligations. Your card details are processed by Stripe; we never see them.
• Traveller tips: the text, the name and country (optional), the place and the date, internally linked to your pass. They are shown to other pass holders (never your code or email). We receive an email notification so that we can moderate them. Legal basis: your consent when posting; you can ask us to delete them.
• Security: we store your IP address with a timestamp for up to 24 hours to prevent abuse, such as trying many codes in a row. The server may also record technical data (IP address, date, page) in its access logs for a limited time. Legal basis: our legitimate interest in protecting the service.
• Location: if you allow it, your phone uses your location to show nearby places and distances. Your location is not sent to our server. You can refuse or withdraw permission at any time.

Data stored on your phone

The app stores in your browser the language you chose, your access code, a copy of the places for offline use and whether you closed the install message. This is only needed for the app to work. We do not use cookies or any analytics, tracking or advertising tools.

Who we share data with

• IONOS (web hosting and email sending, servers in the EU), as data processor.
• Stripe (Stripe Payments Europe Ltd., Ireland) to process the payment. Stripe also processes data as a controller under its own privacy policy and may transfer it outside the EU with the safeguards required by the GDPR.
• OpenFreeMap and OpenStreetMap: your browser loads the map directly from their servers, which receive your IP address.
• WhatsApp and Google Maps: only if you tap their buttons, that service opens and its own terms apply.

We do not sell your data or use it for advertising.

How long we keep it

Pass data: while the pass is active and afterwards for the periods required by law (for example, accounting and tax obligations). Tips: while the app is active or until you ask us to delete them. Security IP addresses: 24 hours at most.

Your rights

You can ask to access, correct or delete your data, object to or restrict its processing, receive it in a portable format, or withdraw your consent. Email us at info@albanobiketours.com with your code or email address. If you are not satisfied with our answer, you can complain to the Spanish Data Protection Agency (www.aepd.es) or to the data protection authority of your country.

Condiciones de venta

1. Qué compras

Un pase de acceso a «Albano’s Valencia», una app web con un mapa de lugares recomendados por Albano, sus descripciones y los consejos de otros viajeros. El precio y la duración del pase se muestran antes de pagar (actualmente 4,99 € por 7 días de acceso). El precio es final, con impuestos incluidos. Es un pago único: no hay suscripción ni renovación automática.

2. Compra y pago

El pago se realiza a través de Stripe. Para comprar debes ser mayor de edad. El contrato queda cerrado cuando el pago se confirma. En ese momento ves tu código de acceso (por ejemplo ALB-XXXXXXXX) en pantalla y te lo enviamos por email, junto con la confirmación de tu compra. El contrato está disponible en neerlandés, inglés y español.

3. Duración y uso del pase

El pase empieza a contar en el momento de la compra y dura el número de días indicado (7 días son 7 × 24 horas). Los códigos que se entregan con un tour en bici empiezan a contar la primera vez que se usan. Puedes usar tu código en tus propios dispositivos. El pase es personal: no está permitido revenderlo ni publicarlo. Podemos bloquear códigos que se usen de forma abusiva.

4. Derecho de desistimiento

Como consumidor, normalmente tienes 14 días para desistir de una compra online. En este caso se trata de contenido digital que recibes de inmediato. Por eso, antes de pagar te pedimos que aceptes expresamente empezar a usar el pase en ese momento y que reconozcas que, una vez empieza el acceso, pierdes el derecho de desistimiento (artículo 103.m del Real Decreto Legislativo 1/2007, Ley General para la Defensa de los Consumidores y Usuarios). Te confirmamos esta aceptación en el email de compra.

5. Si algo no funciona

Si la app no funciona por un problema nuestro, escríbenos a info@albanobiketours.com con tu código. Si no podemos solucionarlo en un plazo razonable, te devolvemos el importe. Esto no limita tus derechos legales como consumidor sobre la conformidad del contenido digital.

6. Contenido

Los lugares y textos son recomendaciones personales. Podemos actualizar, añadir o quitar lugares en cualquier momento para mantener la guía al día. No somos responsables de los servicios de terceros (restaurantes, museos, etc.) ni de cambios en sus horarios, precios o disponibilidad.

7. Consejos de viajeros

Si publicas un consejo, lo verán los demás usuarios con pase, junto con el nombre y el país que indiques (son opcionales). No publiques contenido ilegal, ofensivo o publicitario, ni datos personales de otras personas. Podemos ocultar o borrar cualquier consejo. Al publicarlo, nos permites mostrarlo en la app.

8. Disponibilidad

Hacemos lo posible para que la app funcione siempre, pero puede haber interrupciones breves por mantenimiento o por causas ajenas a nosotros.

9. Ley aplicable

Estas condiciones se rigen por la ley española. Si eres consumidor, conservas la protección que te den las leyes de tu país de residencia y puedes acudir a los tribunales de tu domicilio. Si tienes una queja, escríbenos primero: intentaremos resolverla contigo. A cada compra se le aplican las condiciones vigentes en el momento de pagar.

Qué datos tratamos y para qué

• Compra del pase: tu email (nos lo facilita Stripe tras el pago), tu código de acceso, las fechas del pase y la referencia del pago. Los usamos para darte acceso, enviarte y recuperar tu código, atender incidencias y cumplir obligaciones contables. Base legal: la ejecución del contrato y el cumplimiento de obligaciones legales. Los datos de tu tarjeta los trata Stripe; nosotros no los vemos.
• Consejos de viajeros: el texto, el nombre y el país (opcionales), el lugar y la fecha, vinculados internamente a tu pase. Se muestran a otros usuarios con pase (nunca tu código ni tu email). Recibimos un aviso por email para poder moderarlos. Base legal: tu consentimiento al publicar; puedes pedirnos que los borremos.
• Seguridad: guardamos tu dirección IP con la hora durante un máximo de 24 horas para frenar abusos, como probar muchos códigos seguidos. Además, el servidor puede registrar datos técnicos (IP, fecha, página) en sus registros de acceso durante un tiempo limitado. Base legal: nuestro interés legítimo en proteger el servicio.
• Ubicación: si lo permites, tu móvil usa tu ubicación para mostrar los lugares cercanos y las distancias. Tu ubicación no se envía a nuestro servidor. Puedes negar o retirar el permiso en cualquier momento.

Datos guardados en tu móvil

La app guarda en tu navegador el idioma elegido, tu código de acceso, una copia de los lugares para usarla sin conexión y si has cerrado el aviso de instalación. Solo sirve para que la app funcione. No usamos cookies ni herramientas de analítica, seguimiento o publicidad.

Con quién compartimos datos

• IONOS (alojamiento web y envío de emails, servidores en la UE), como encargado del tratamiento.
• Stripe (Stripe Payments Europe Ltd., Irlanda) para procesar el pago. Stripe también trata datos como responsable según su propia política de privacidad y puede transferirlos fuera de la UE con las garantías que exige el RGPD.
• OpenFreeMap y OpenStreetMap: tu navegador descarga el mapa directamente de sus servidores, que reciben tu dirección IP.
• WhatsApp y Google Maps: solo si pulsas sus botones, se abre ese servicio y se aplican sus propias condiciones.

No vendemos tus datos ni los usamos para publicidad.

Cuánto tiempo los guardamos

Los datos del pase, mientras esté activo y después durante los plazos que exige la ley (por ejemplo, obligaciones contables y fiscales). Los consejos, mientras la app esté activa o hasta que pidas borrarlos. Las direcciones IP de seguridad, 24 horas como máximo.

Tus derechos

Puedes pedir acceder a tus datos, corregirlos, borrarlos, oponerte a su tratamiento, limitarlo, recibirlos en un formato portable o retirar tu consentimiento.
